Privacy Policy

Introduction

RiseGame, LLC (“Company” or “We” or “RiseGame”) respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you purchase, download, install, register with, access, or use the RiseGame mobile application and web platform (collectively, the “Service”).
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect through the Service, in email, text, and other electronic communications sent through or in connection with the Service, and ANY OTHER SOURCES.

This policy DOES NOT apply to information that:

  • We collect offline or on any other Company apps or websites you may access through the Service.
  • You provide to or is collected by any third party (see Third-Party Information Collection).
  • Information you provide to any other source not affiliated with or under the control of RiseGame.

Our OTHER websites and apps, and other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Service. By downloading, registering with, or using the Service, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Service after we revise this policy means you accept those changes, so please check the policy periodically for updates.

RiseGame’s Tryout Scheduler is used by parents and legal guardians to register children for youth sports tryouts, and we have actual knowledge that some registered Players are under the age of 13. This section describes our practices regarding personal information we collect from or about children under 13 (“Children’s Information”), consistent with the Children’s Online Privacy Protection Act (COPPA).

Children’s Information we collect. When a parent or legal guardian registers a child for a tryout, we collect the Player’s name, date of birth, sport/position and team information, and — where a parent, Coach, or Team Admin chooses to upload them — photos, video, or audio of the Player. This information is provided directly by the registering parent or guardian, not by the child.

How we use it. We use Children’s Information solely to operate the tryout registration and scheduling features of the Service (for example, creating a Player roster entry, communicating tryout logistics to the registering parent, and generating performance or scheduling records the Organization requests). We do not use Children’s Information to serve targeted advertising, and we do not disclose Children’s Information to third parties for marketing or advertising purposes.

Verifiable parental consent. Before we collect a Player’s information, the registering adult must check a box certifying that they are the Player’s parent or legal guardian, and must confirm the registration by clicking a link sent to the email address they provide. By completing these steps and submitting the Player’s information, the parent or guardian provides verifiable consent to our collection and use of the Player’s information as described in this section.

Parental rights. If you are a parent or legal guardian of a Player, you may at any time: (1) review the specific Children’s Information we have collected; (2) refuse to permit our further collection or use of that information; (3) request that we delete the Player’s information; and (4) revoke your prior consent. To exercise any of these rights, contact us at info@risegame.com with the subject line “Parent/Guardian Privacy Request.” We will respond within 30 days.

No over-collection. We do not condition a Player’s registration or participation in a tryout on providing more information than is reasonably necessary for that activity. Any additional fields (such as optional surveys) are clearly marked optional.

Third-party disclosure. We do not disclose Children’s Information to advertising networks, data brokers, or third-party marketers. We may share a Player’s information with the sports Organization, Team Admin, or Coach conducting the tryout, and with service providers who process it solely to operate the Service on our behalf (see Data Security and Data Retention below).

If we learn we have collected a child’s personal information outside the process described above, or without verifiable parental consent, we will delete it. Questions or complaints about our handling of a child’s information can be directed to info@risegame.com.

Separately from the COPPA protections above, California residents between the ages of 13 and 15 have the right under California law to opt in before we sell or share their personal information. We do not currently sell or share personal information of any user in this age range. See Multi-State Privacy Rights for more information.

We collect information from and about users of our Service:

  • Directly from you when you provide it to us.
  • Automatically when you use the Service.
  • Feedback Surveys.

When you download, register with, or use the Service, we may ask you to provide information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, or ANY OTHER INFORMATION THE SERVICE COLLECTS THAT IS DEFINED AS PERSONAL OR PERSONALLY IDENTIFIABLE INFORMATION UNDER AN APPLICABLE LAW/any other identifier by which you may be contacted online or offline (“personal information”).
  • That is about you but individually does not identify you, such as location, specific sports organization, or team names.

This information includes:

  • Information that you provide by filling in forms in the Service. This includes information provided at the time of registering to use the Service and subscribing to our service, posting material, and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the Service.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through the Service and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Service.
  • Your search queries on the Service.
  • Player or User statistics typical in a variety of sports and athletic activities.
  • Game times and scores.
  • Photos, video, or audio of a Player, where a parent, Coach, or Team Admin chooses to upload them (see Children’s Privacy above for how this is handled for Players under 13).

You may also provide information for publication or display (“Posted”) on public areas of the app or websites you access through the Service and/or RiseGame.com (collectively, “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

When you download, access, and use the Service, it may use technology to automatically collect:

  • Usage Details. When you access and use the Service, we may automatically collect certain details of your access to and use of the Service, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Service.
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
  • Stored Information and Files. The Service may also access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
  • Location Information. This Service does not collect real-time information about the location of your device.

On pages of the Tryout Scheduler where a parent or guardian enters Player information, we limit automatic data collection technologies to those necessary to operate, secure, and troubleshoot the Service (for example, detecting fraudulent registrations). We do not use tracking technologies on those pages for third-party behavioral advertising, and Children’s Information is not combined with ad-network or behavioral-tracking data.

If you do not want us to collect this information, you may opt out at any time by: (1) deleting the app or ceasing use of the web platform; or (2) requesting deletion of your account by emailing RiseGame at info@risegame.com. You may also opt out by using opt-out methods provided by your device or app store. For more information, see Your Choices About Our Collection, Use, and Disclosure of Your Information. Note that opting out of the Service’s collection of location information will disable its location-based features.

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). This behavioral tracking does not apply to Children’s Information, as described above. For information on how you can opt out of behavioral tracking on or through this Service and how we respond to browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking, please contact us at info@risegame.com.

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone or computer. It may be possible to refuse to accept cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of our Service.
  • Web Beacons. Pages of the Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

When you use the Service or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • Advertisers, ad networks, and ad servers.
  • Analytics companies.
  • Your mobile device manufacturer.
  • Your mobile service provider.
  • Your sports organization.

These third parties may use tracking technologies to collect information about you when you use this Service. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. This does not apply to Children’s Information, which is not shared with these third parties for such purposes.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

The marketing and targeted-advertising uses described in this section do not apply to Children’s Information, which we use only as described in Children’s Privacy above.

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Service and its contents, and any other information, products, or services that you request from us.
  • Fulfill any other purpose for which you provide it.
  • Give you notices about your account and/or subscription, including expiration and renewal notices.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you when Service updates are available, and of changes to any products or services we offer or provide through it.
  • Information you enter into our system when using the Service, such as other personal or performance (health/fitness) information used by our program to define and direct your training and development or provide content in the form of educational information, products, services, events or promotions for such that matches your expressed interests.

The usage information we collect helps us to improve our Service and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Service according to your individual interests.
  • Speed up your searches.
  • Recognize you when you use the Service.

We may also use your email address or phone number to contact you, or to allow our partners to contact you, about goods, services, offers, or promotions that may be of interest to you. This applies only to your own contact information as the registering parent or guardian — it does not apply to your Player’s information, which is used only as described in Children’s Privacy above. If you do not want us to use your information in this way, you can opt out at any time as described in Your Choices About Our Collection, Use, and Disclosure of Your Information.

We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

The third-party marketing and advertising disclosures described in this section do not apply to Children’s Information, which we disclose only as described in Children’s Privacy above.

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To the Team Admin, Coach, or Organization administering your Player’s tryout, we disclose the registering parent or guardian’s name and phone number so they may contact you regarding tryout logistics. This disclosure is integral to operating the Service.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of RiseGame’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by RiseGame about our Service users is among the assets transferred. A transfer of Children’s Information to a party who will use it for a new purpose beyond operating the Service as described in Children’s Privacy above will require new parental notice and consent before that new use begins.
  • To third parties to market their products or services to you if you have not opted out of these disclosures (this does not include Children’s Information).
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Website or Service, we will transmit the contents of that email and your email address to the recipients.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, including any applicable terms of service, and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of RiseGame, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information. If you are a parent or legal guardian seeking to exercise rights over your child’s information, see Children’s Privacy above.

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the Service to collect information through other tracking technologies by using your device’s privacy settings or by contacting us at info@risegame.com. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Service may then be inaccessible or not function properly.

Location Information. You can choose whether or not to allow the Service to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Service may become inaccessible or not function properly.

Promotion by the Company. If you do not want us to use your email address or phone number to promote our own or third parties’ products or services, you can opt-out by contacting us at info@risegame.com. You can also always opt-out by logging into the Service and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes, by clicking the unsubscribe link in any marketing email, or by sending us an email stating your request to info@risegame.com.

Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by contacting us at info@risegame.com. You can also always adjust your user advertising preferences in your account profile by checking or unchecking the relevant boxes or by sending an email stating your request to info@risegame.com.

Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by contacting us at info@risegame.com. You can also always opt-out by logging into the Service and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to info@risegame.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

We use the phone number a registering parent or guardian provides to send tryout-related communications, such as confirmation, scheduling, and coach-contact messages, which are administrative in nature and necessary to operate the Service. If we ever offer an optional program to send promotional or non-administrative text messages, we will obtain your separate affirmative consent before enrolling you, and you may opt out at any time by replying “STOP” to any such message; reply “HELP” for assistance. Message and data rates may apply. We are not liable for delayed or undelivered messages caused by carrier network issues.

You can review and change your personal information by logging into the Service and visiting your account profile page.

You may also send us an email at info@risegame.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Service, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users. Proper access and use of information provided on the Service, including User Contributions, is governed by our terms of service https://risegame.com/terms-of-service/.

Residents in certain states, such as California, may have additional personal information rights and choices. Please see Multi-State Privacy Rights for more information. Parents and legal guardians of a Player under 13 should see the Parental Rights described in Children’s Privacy above.

We do not currently sell or share personal information with third parties for cross-context behavioral advertising, and we do not currently engage in targeted advertising using personal information collected through the Service. If this changes in the future, we will update this policy, provide a dedicated opt-out mechanism, and honor Global Privacy Control (GPC) signals from browsers that send them, as required by applicable state law.

Depending on your state of residence, you may have additional rights regarding your personal information, which may include the right to: (1) know or access the categories and specific pieces of personal information we have collected about you; (2) correct inaccurate personal information; (3) delete personal information we have collected from you, subject to certain exceptions (for example, to complete a transaction, comply with a legal obligation, or maintain an active tryout registration); and (4) not be discriminated against for exercising any of these rights.

To exercise any of these rights, email info@risegame.com. We may need to verify your identity before completing your request. If we deny a request, you may appeal by replying to our denial with the word “Appeal”; we will respond to appeals within 45 days.

We will not discriminate against you for exercising any privacy right described in this policy, including by denying goods or services, charging different prices, or providing a different level of service.

Nevada residents. We do not sell personal information as defined by Nevada law (Nevada Revised Statutes Chapter 603A). If this changes, Nevada residents may submit a request to opt out by emailing info@risegame.com.

California minors. If you are a California resident under 18 and you posted content through the Service, you may request that we remove or anonymize that content by emailing info@risegame.com, to the extent required by California law.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to info@risegame.com.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

We maintain a written information security program with administrative, technical, and physical safeguards calibrated to the sensitivity of the personal information we collect, including additional safeguards specific to Children’s Information collected through the Tryout Scheduler.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Service like message boards. The information you share in public areas may be viewed by any user of the Service.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Service. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

We retain personal information only for as long as reasonably necessary to fulfill the purpose for which it was collected. For Children’s Information specifically: Player registration and roster information is retained for the duration of the tryout season and the Organization’s active use of the Service, and for 24 months afterward to support historical team records requested by the Organization, after which it is deleted or de-identified. Photos, video, or audio of a Player are retained until the parent or guardian requests deletion, or for 24 months after the associated season ends, whichever is earlier. A parent or guardian may request earlier deletion at any time as described in Parental Rights above.

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Website home page or through in-Service messaging.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and/or phone number for you and for periodically visiting this privacy policy to check for any changes.
